Basis of Contract
If you are creating an account on behalf of a business or organization, you confirm that you have the authority to act on its behalf and to agree to these Terms and Conditions.
Your account will be considered active from the moment you accept our Terms and Conditions, register on our platform, or begin using our services, whichever occurs first. At that point, a binding agreement is established between you and SMS Pasal under these Terms.

Services Overview
SMS Pasal provides bulk SMS services including promotional SMS, transactional SMS, OTP delivery, and SMS API integration. Services are subject to availability and telecom operator regulations.
User Responsibilities
By using our services, you agree that:
- You will use SMS services only for lawful purposes
- You will not send unsolicited or spam messages
- You will obtain proper consent from recipients before sending messages
- You will comply with all applicable laws and regulations, including telecom rules in Nepal
- You are solely responsible for the content of all messages sent through our platform
- You will only send sms to users who are subscribed to your service on a regular basis
- If SMS is sent to an unregistered number, the telecom operator will consider it delivered. Consequently, no refund or compensation will be provided for undelivered messages sent to unregistered numbers.
Prohibited Use
You must not use SMS Pasal services to:
- Send fraudulent, misleading, or deceptive messages
- Promote illegal activities or content
- Sending abusive, offensive, or harmful content against the community, religion, or person will be fined at least 1,00,000 along with legal action as per government law.
- Violate privacy rights or data protection laws
- Distribute malware, phishing links, or scams
- Any information that is strictly confidential or prohibited by law
- The user is responsible for any repeated or continuous SMS sent due to technical errors on their end.
- Our bulk SMS Service is only for those companies registered in Nepal
We reserve the right to suspend or terminate accounts involved in such activities without prior notice.
Account Registration and Security
- You must provide accurate and complete information when creating an account
- You must be over 18 years old to register or create an account with SMSpasal
- You are responsible for maintaining the confidentiality of your login credentials
- Any activity conducted through your account is your responsibility
- Each user may have only one account with SMS Pasal, unless otherwise agreed. We may cancel any additional accounts you register.
- SMS Pasal is not liable for unauthorized access due to user negligence
Messaging and Delivery
- SMS delivery is dependent on telecom operators and network availability
- We do not guarantee delivery time, success rate, or uninterrupted service
- Delays or failures may occur due to factors beyond our control
- SMS credits will be deducted even if messages are not delivered due to issues with the recipient’s number (e.g., switched off, out of network, inactive SIM).
- Any changes by the Government of Nepal, NTA, or telecom operators (e.g., SMS rates, Sender ID, or related services) beyond SMS Pasal’s control will take immediate effect, regardless of their impact on SMS Pasal or users.
Pricing and Payments
- SMS services operate on a prepaid credit system
- All payments must be made in advance
- Purchased SMS credits are non-refundable and non-transferable
- Prices may change without prior notice
API Usage
- API access is provided for integration purposes only
- You must not misuse, overload, or attempt to disrupt the system
- Any abuse of API services may result in immediate suspension
Data and Privacy
- You are responsible for the data you upload and process
- SMS Pasal does not claim ownership of your data
- We implement reasonable measures to protect your data, but do not guarantee absolute security
- SMS Pasal will protect the confidentiality and privacy of your information. Likewise, users must not share confidential information, such as service costs, terms, or data (e.g., mobile numbers) obtained through SMS Pasal with any third party.
Service Availability
- We aim to provide reliable services, but we do not guarantee uptime
- Maintenance or technical issues may temporarily interrupt services
Limitation of Liability
SMS Pasal shall not be liable for:
- Any loss of business, revenue, or profits
- Message delivery failures or delays
- Indirect or consequential damages arising from service use
Indemnification
You agree to indemnify and hold SMS Pasal harmless from any claims, damages, or legal actions arising from your use of the service or violation of these terms.
Termination
We reserve the right to suspend or terminate your account at any time if:
- You violate these Terms and Conditions
- You misuse the platform or services
- Required by law or regulatory authorities
- Either the user or SMS Pasal may terminate the contract by providing at least one week’s prior notice.
